| Résumé: | تتعرض الدول أحيانا إلى أزمات اقتصادية تلقى بظلالها على كافة الأنشطة سواءا الحكومية منها أو الخاصة، مما يستلزم اتخاذ مجموعة من التدبير الإقتصادية والإجتماعية والقانونية للتكيف مع مخرجات هذه الأزمة، وتعد العقود الإدارية من أكثر الأعمال الإدارية التي تتأثر سلبا بمثل هذه الظروف كونها أنشأت وتم الإتفاق على بنودها في ظروف إقتصادية مغايرة تماما للظروف التي يتوجب فيها الوفاء بهذه الإلتزامات، وهذا ما دفع المشرع والقضاء لخلق نظرية قانونية للتعامل مع الظروف الإقتصادية المتقلبة وغير المستقرة، ولها أهميتها الخاصة كونها جاءت لضمان مبدأ هام من المبادئ العامة للقانون وهو مبدأ سيرورة المرفق العام بانتظام واضطراد وعدم انقطاع الخدمة العمومية عن المنتفعين. |
