| Résumé: | إن الصفقات العمومية وسيلة هامة تستعين بها الدولة لتحقيق أنشطتها الاستثمارية، ودفع عجلة التنمية إلى الأمام على جميع الأصعدة؛ وذلك سواء تعلق الأمر بالمجال الاقتصادي أو الاجتماعي، أو العمراني ... الخ غير أن ميدان الصفقات العمومية يعتبر من أهم المجالات التي استفحل فيها الفساد؛ وذلك لارتباطه بالمال العام، لأن الصفقات العمومية عقود ممولة بميزانية الدولة، حيث ظهر إلى العيان أن هناك الكثير من التجاوزات القانونية في مجال الصفقات العمومية التي تؤدي إلى إهدار و تبديد المال العام. وبما أن الموظف العام هو المنوط به التكفل بإجراءات هذه العقود، وعنصرا فاعلا في تمامها وانعقادها، فقد يمنح امتيازات غير مبررة للغير، أو يستفيد شخصيا بغير وجه حق من امتيازات في ذات المجال. الكلمات المفتاحية: الصفقات العمومية، الفساد، الموظف العام، منح، امتيازات غير مبررة، الغير. |
