| Résumé: | تناولت الدراسة الوضعيات القانونية للموظف العا حسب المادة 127 من الأمر رقم 06-03، والتي تشمل القيام، الانتداب خارج الإطار، الاستيداع، والخدمة الوطنية، حيث تمثل هذه الوضعيات مراحل هامة في مسيرة الموظف المهنية. تُعد هذه الوضعيات ضرورية قانونياً وتقنيا لضمان مرونة العمل في الوظيفة العمومية، وتلبية احتياجات المرافق العامة لضمان استمرارية الخدمة العمومية، مع الالتزام بالقوانين المنظمة بها . وفي هذا السياق، جاء المرسوم التنفيذي رقم 20-373 لتوضيح بعض النقاط وتغطية الثغرات المتعلقة بهذه الوضعيات الواردة في الأمر 06-03 كما تهدف ىذه الوضعيات إلى مراعاة الجوانب السياسية والاجتماعية للموظف، ورفع كفاءته العملية، لتتناسب مع احتياجات الإدارة والموظف على حد سواء |
| Description: | This study analyzed the legal statuses of public employees according to Article 127 of Order No. - 06 03, including active duty, secondment outside the framework, leave of absence, and national service. These statuses represent key stages in the employee’s career. They are legally and technically essential to ensure flexibility within the public service, meeting the needs of public institutions and guaranteeing continuity of public services, all under the governing laws and regulations. In this context, Executive Decree No. 20-373 dated December 12, 2020, was issued to clarify ambiguous points and address gaps related to these statuses under Order - 06 03. Furthermore, these statuses consider the political and social needs of employees and aim to enhance their professional level, effectively aligning the requirements of both the administration and the public employee. |
