| Résumé: | يعد تعويض ضحية الجريمة امر تمليه اعتبارات العدالة، اذ يجب الا يضاف الى الضرر الذي يلحق بالشخص جراء الجريمة ضرر آخر يتمثل في تجاهل حقه في التعويض ، واذا ماعرفنا ان من واجبات الدولة الاهتمام بالمواطن بشكل عام فمن باب اولى ان تولي اهتماما اكثر للمواطن ضحية الجريمة من خلال سن تشريعات التي تكفل حقه في الحصول على التعويض دون مشقة ، او على الأقل توفير الضمانات له اسوة بالمتهم. |
| Description: | Compensating the victim of a crime is a matter dictated by considerations of justice. A person who suffers harm due to a crime should not be subjected to further harm through the denial of their right to compensation. Given that it is the duty of the state to care for its citizens in general, it is even more imperative that it gives special attention to crime victims by enacting legislation that guarantees their right to compensation without undue hardship—or at the very least, by providing safeguards similar to those available to the accused. Just as the offender has the right to a fair trial, including the right to defense, society is also obligated to ensure that the victim receives fair compensation for the harm they have suffered. The issue of compensating crime victims is a subject of ongoing debate—not regarding the principle itself, but the manner in which it is implemented. Difficulties often arise in the procedures required to obtain compensation, especially when the perpetrator is unknown or lacks the means to pay |
