dc.description	Intentional homicide is an attack on human life and a deliberate violatin of it this is what the algerian legislator stipulated in the penal code which includes different forms such as premeditated murder . quasi intentional murder manslaughter and aggravating circumstances for homicide crimes The law considers certain circumstances as aggravating when they accompany the crime and show the perpetrators intention clearly Among these is premeditation and lying in wait where the criminal prepares in advance with the clear intent to kill and take the victims life ; The legislator also considers another aggravating circumstance murder under torture which involves the use of brutal and inhumane methods to take life The law provides the judge with authority and discretion in determining the nature of these aggravating factors	en_US
dc.description.abstract	القتل العمدي هو مساس بحياة الانسان وإزهاق روحه عمدا هذا مانص عليه المشرع الجزائري في قانون العقوبات والذي ميزها عن قتل شبه العمد والقتل الخطأ والظروف المشددة لجريمة القتل نص عليها المشرع وهذا عند اقترانها بظرف من ظروف التشديد وهي عند اقتران جريمة القتل بعنصر سبق الإصرار والترصد بهذا الظرف تظهر نية الجاني العمدية للقتل وإزهاق الروح ، ونص المشرع على ظرف أخر وهو القتل بالتعذيب أو استعمال وسائل وحشية لارتكاب جريمة القتل وإعطاء القاضي السلطة والصلاحيات في تحديد النظر إلى طبيعة الظرف	en_US
