| Résumé: | يخضع اختراع المنتجات الصيدلانية في الجزائر النظام براءات الاختراع المحدد في القانون رقم 03 - 07 و المرسوم التنفيذي رقم 13 / 366 ، تخضع هذه المنتجات لأحكام وإجراءات خاصة تهدف إلى تحقيق التوازن بين منح المخترع احتكارا مؤقتا لمنتجه والسماح بتوفيره في الأسواق بأسعار معقولة . ان تمنح براءة الاختراع صاحبها الحق الحصري في استغلال إختراعه لفترة زمنية محددة، ينهي هذا الحق ليصبح المنتج ملكاً عاماً: مما يتيح المجال الإنتاج الأدوية الجنيسة من قبل مختلف المؤسسات الصيدلانية. تلعب براءة اختراع دورا هاما في تنظيم الأنشطة الاقتصادية المتعلقة بالملكية الفكرية وحمايتها، وتشجيع الابتكار، مع مراعاة حقوق المقترعين |
| Description: | In Algeria، the invention of pharmaceutical products is subject to the patent system defined by Law No. 03-07 and Executive Decree N °. 13/366. These products are governed by specific provisions and procedures aimed at achieving a balance between granting the inventor a temporary monopoly over their product and ensuring its availability in the market at affordable prices. A patent grants its holder the exclusive right to exploit their invention for a limited period، after which this right expires and the product enters the public domain، allowing the production of generic drugs by various pharmaceutical companies. Patents play a vital role in regulating economic activities related to intellectual property and its protection، encouraging innovation while respecting inventors' rights |
