| Résumé: | تبحث هذه المذكرة في واقع المؤسسات الدستورية الاستشارية في الجزائر ، وتحلل مدى فعاليتها واستقلاليتها في ظل التعديلات الدستورية لعامي 2016-2020 ، كما تناقش اشكالية التضخم المحتمل في عدد الهيئات ، تهدف الدراسة الى تقديم رؤية متكاملة لدور هذه المؤسسات بدءا من تأصيلها المفاهيمي ومكانتها الدستورية ، مرورا بتقييم ادائها الفعلي وتحدياته. |
| Description: | This dissertation examines the reality of constitutional consultative institutions in Algeria, analyzing their effectiveness and independence in light of the 2016 and 2020 constitutional amendments. It also discusses the potential issue of "inflation" in the number of these bodies. The study aims to provide a comprehensive vision of the role of these institutions, starting from their conceptual grounding and constitutional status, through an evaluation of their actual performance and challenges. The dissertation highlights that modern constitutional texts have elevated the status of consultative institutions. However, challenges related to ensuring their true independence, enhancing the impact of their non binding opinions, and addressing the overlap in jurisdictions resulting from their multiplicity, still persist. Consequently, the study concludes by offering practical suggestions aimed at strengthening the effectiveness and independence of these institutions, by improving legal and administrative frameworks, activating coordination mechanisms, and benefiting from international experiences, thereby contributing to maximizing their role in promoting good governance and stability in Algeria. |
