Résumé: تُعد الصفقات العمومية من الأدوات الأساسية التي تعتمد عليها الإدارة العمومية في تحقيق أهداف التنمية وتلبية حاجات المجتمع. في التشريع الجزائري، تَكرست مجموعة من المبادئ العامة التي ترمي إلى ضمان شفافية ونزاهة وفعالية هذه الصفقات، أبرزها : مبدأ حرية الدخول إلى السوق، مبدأ المساواة في المعاملة بين المتعهدين، مبدأ الشفافية في الإجراءات، مبدأ المنافسة الحرة.
Description: Public transactions are one of the basic tools that public administration relies on to achieve development goals and meet the needs of society. In the Algerian legislation, a set of general principles are enshrined aimed at ensuring the transparency, integrity and effectiveness of such transactions, the most prominent of which are: The principle of free access to the market, the principle of equal treatment between operators, the principle of transparency in procedures, the principle of free competition. The Algerian legal framework strictly regulates public transactions, especially after the issuance of Presidential Decree No. 15-247, which is considered a pivotal point in the development of the system of public transactions and their control, in particular the new amendment to this law through law 23-12 dated August 05, 2023, however, these principles face practical challenges in the form of weak control and lack of full compliance with it, which may lead to manifestations of corruption or waste of public money. Therefore, the importance of the control exercised over public transactions distributed among: Administrative control (within the administration), judicial control (through the courts), financial control (through competent bodies such as the accounting board). This control is aimed at ensuring respect for legal procedures, achieving the public interest, protecting public money, promoting transparency and fair competition. Therefore, it can be said that the development of control and audit mechanisms, as well as enhancing the training and awareness of transaction professionals, remain priorities that contribute to improving the effectiveness of the public transaction system in Algeria.
