| Résumé: | يُعد الغش في بيع السلع والتدليس في المواد الغذائية والطبية من أخطر الممارسات التجارية التي تمس بشكل مباشر صحة المستهلك وثقته في السوق ، ويتمثل الغش في التلعب بمواصفات السلعة أو مكوناتها أو وزنها أو تاريخ صلحيتها بهدف تحقيق أرباح غير مشروعة، أما التدليس، فيرتبط بتقديم معلومات كاذبة أو مضللة حول طبيعة المنتج أو مصدره أو فوائده، بقصد خداع المستهلك ودفعه للشراء، وتكتسي هذه الأفعال خطورة بالغة في حال تعلقها بمواد غذائية أو طبية، نظرا لتأثيرها المباشر على صحة الإنسان وسلمته. وقد تدخل المشرع بنصوص قانونية صارمة تجرم هذه الأفعال وتفرض عقوبات زجرية تشمل الحبس والغرامة، إلى جانب إتلف المنتجات المغشوشة، كما تم تفعيل آليات إدارية للرقابة والتفتيش لضبط المخالفات ومتابعة مصادرها. |
| Description: | Fraud in the sale of goods and deception of food and medical supplies are among the most dangerous commercial practices that directly affect consumer health and confidence in the market. Fraud involves manipulating a product's specifications, components, weight, or expiration date with the aim of generating illicit profits. Deception, on the other hand, involves providing false or misleading information about the nature, source, or benefits of a product with the intent of deceiving consumers and influencing them to purchase. These acts are particularly serious when they involve food or medical supplies, given their direct impact on human health and safety. Legislators have enacted strict legal provisions criminalizing these acts and imposing deterrent penalties, including imprisonment and fines, in addition to the destruction of adulterated products. Administrative oversight and inspection mechanisms have also been implemented to detect violations and track down their sources. |
