| Résumé: | يخضع قاضي التحقيق في أداء مهمته كمحقق لرقابة غرفة الاتهام، بالدرجة الاولى، كما انه يخضع ايضا ولو بدرجة اقل لرقابة أطراف الدعوى، أما الرقابة على أعمال قاضي التحقيق القضائية فتتم بواسطة الطعن عن طريق الاستئناف الذي يرفع أمام غرفة الاتهامفي الأوامر القضائية التي يصدرها قاضي التحقيق، ومنه تمارس غرفة الاتهام رقابتهاعلى قاضي التحقيق كهيئة تحقيق من الدرجة الثانية،ومن جهة أخرى يخضع أمر قاضي التحقيق بإرسال مستندات الدعوى إلى النائب العامعند الانتهاء من التحقيق في المواد الجنائية، إلى نظام خاص حيث تمارس غرفة الاتهام رقابتها عليه بصفة آلية ولو بغياب أي استئناف وتقتضي هذه الرقابة إجراءات مميزة ينظمها قانون الإجراءات الجزائية الجزائري |
| Description: | The investigating judge, in carrying out his duties as an investigator, is primarily subject to the supervision of the Indictment Chamber. He is also subject, albeit to a lesser extent, to the oversight of the parties to the case. Judicial review of the investigating judge’s decisions is conducted through appeals brought before the Indictment Chamber against judicial orders issued by the judge. Thus, the Indictment Chamber exercises its supervisory authority over the investigating judge as a second-level investigative body. Furthermore, when the investigating judge issues an order to transmit the case files to the Public Prosecutor upon the completion of the investigation in criminal matters, this order is subject to a special legal regime. In such cases, the Indictment Chamber exercises automatic oversight, even in the absence of an appeal.
