| Résumé: | تهدف هذه الدراسة الى تسليط الضوء على نظام البيوع المقننة في التشريع الجزائري، مركز على البيع بالتخفيض كنموذج تطبيقي بارز ضمن هذه البيوع ، وقد تناولت الدراسة الاطار القانوني الذي ينظم هذه الممارسات التجارية من خلال تحليل النصوص القانونية ذات الصلة ، لاسيما القانون رقم 04-02 والمرسوم التفيذي رقم 06-215، وركزت على الشروط الموضوعية والشكلية التي تحكم البيع بالتخفيض. |
| Description: | This study aims to shed light on the system of regulated sales in Algerian legislation, focusing on sales at reduced prices as a prominent model among these practices. The research explores the legal framework governing such commercial activities by analyzing relevant legal texts, particularly Law No. 04-02 and Executive Decree No. 06- 215. It highlights both the substantive and procedural conditions that apply to sales at reduced prices, along with the administrative procedures and sanctions associated with violations of the applicable rules. The study also examines the practical challenges facing the implementation of these legal provisions and assesses their effectiveness in protecting consumers and regulating market activity. It concludes that, despite the importance of the current legal system, there is a need to strengthen oversight mechanisms and update legal tools to keep pace with market developments |
