| Résumé: | تتناول هذه المذكرة عقود الفيديك باعتبارها نموذجًا دوليًا موحدًا لتنظيم عقود البناء والتشييد، وذلك في ظل التحولات الاقتصادية والاجتماعية والتقنية التي يشهدها هذا القطاع على المستوى العالمي. وتبرز أهمية هذه العقود في قدرتها على الاستجابة للتحديات القانونية والفنية الناتجة عن تعقيد المشاريع واتساع نطاقها، لاسيما مع دخول شركات مقاولات دولية كبرى إلى أسوا متعددة خارج حدود بلدانها الأصلية . وقد تبنّت العديد من التشريعات الوطنية عقود الفيديك الصادرة عن الاتحاد الدولي للمهندسين الاستشاريين (FIDIC) كإطار قانوني موثو وفعّال لتنظيم العلاقة التعاقدية بين الأطراف، وذلك من خلال نماذج مختلفة تم تطويرها لتناسب أنواع المشاريع المتعددة. وتتميّز هذه النماذج باحتوائها على شروط عامة وخاصة تنظم توزيع الالتزامات والمخاطر، وتكفل العدالة التعاقدية، إلى جانب توفير آليات بديلة لتسوية النزاعات كالقضاء أو التحكيم، مما يُسهم في تقليل النزاعات وتعزيز الاستقرار القانوني في مشاريع البناء الدولية. |
| Description: | This memorandum examines the FIDIC contracts as a standardized international model for the regulation of construction and engineering contracts, particularly in light of the ongoing economic, social, and technological transformations affecting this sector globally. The significance of these contracts lies in their ability to effectively address the legal and technical complexities arising from large-scale and cross-border projects, especially with the increasing involvement of major international construction firms operating beyond their national jurisdictions. Many national legal systems have adopted the FIDIC contracts, issued by the International Federation of Consulting Engineers (FIDIC), as a reliable legal framework for governing contractual relationships between parties. These contracts comprise various model forms, each tailored to suit the nature of different types of projects. They are characterized by their inclusion of general and particular conditions that regulate the allocation of rights, obligations, and risks, while also ensuring contractual equity. Furthermore, the FIDIC forms incorporate alternative dispute resolution mechanisms, including litigation and arbitration, thereby contributing to the mitigation of disputes and the promotion of legal certainty in international construction projects |
