| Résumé: | انعكست الأهمية الاقتصادية للعقار على مستوى المنظومة القانونية للحجز العقاري ، الذي يتًرتب عليه وضع االمال المحجوز بين يد القضاء ، حتى يستوفي الدائن حقه ، و بالتالي تغل يد المدين المحجوز عليه و يتم بيع العقار بالمزاد العلني ، و ذلك بعد اتخاذ سلسلة من الإجراءات التمهيدية لبيعه و التي تقوم على شروط يمكن الاعتًراض عليها ، بالإضافة إلى إجراءات نهائية تنتهي برسو المزاد لصالح المزايد الذي يقدم أعلى عرض ، و في هذه الحالة يلتزم المشتري الراسي عليه المزاد بدفع الثمن ، و في المقابل يتم نقل ملكية العقار بعد شهر حكم رسه بالمزاد لصالحه |
| Description: | The economic importance of real estate at the legal system of real estate seizure , which results from placing the seized money in the hands of the judiciary to require the creditors his right of it .then it confiscates the seized money from managing the seized money and leads directly to its sale. And that is after taking a series of preparatory measures for public auction that are based on objectionable conditions .and also final procedures which ends by the sales note to the highest offers . the buyer is required to pay the price . and in return the property has passed after the publication of the auction. |
