Résumé: تبقى مرحلة القرن (4-6ه/10-12م) من تاريخ الاندلس استثناء من حيث ظاهرة الجدل والتأليف فيه فقد شهد هذا الجزء من العالم الإسلامي تنوعا في الجدل والتأليف ، حيث شمل جدلا فقهيا وكلاميا وفلسفيا ، ولا بد من الاشارة ان الجدل قد مر بثلاث مراحل، مرحلة الجدل الفقهي بسيط المسائل محدود الوسائل ثم جدل فقهي اصولي متجدد المسائل والوسائل.
Description: The period of the 4th century (6 AH/10-12 AD) of the Andalusian history remains an exception, in terms of the phenomenon of controversy and authorship. Whereby, this part of the Islamic world has witnessed a diversity of controversy and authorship. Wherein, it included a jurisprudential, verbal and philosophical controversy. It must be noted that the controversy has gone through three stages, the stage of a jurisprudential debate known for its simple issues with limited means, then a fundamentalist jurisprudential controversy with renewed issues and means, and at that time this type of hard-work benefited from the methods of the people of theology and logic. Such benefits were seen through the fundamentalist issues that were brought into the circle of hard-work, such as analogy, approval, and dispatched interests. This type of controversy between the Malikis and the apparent people of Andalusia has influenced and enriched the authorship movement in Andalusia. For instance, this kind of controversy has been adopted by great jurists and scholars such as; Ibn Hazm and Al-Baji and Ibn Al-Arabi Al-Ma’afari and many others. Then this type of debate continued to expand its scope into a doctrinal debate, bringing together the Sunnis and their opponents from the Islamic currents, including Shiites, Kharijites, Mu'tazila, and Ash'aris, and their argument intensified over some theological issues. This type of controversy did not remain within the limits of controversy and symmetry, but rather included responses through authorship, which influenced and enriched the authorship movement in Andalusia, and this kind of controversy was enriched Ibn Abd al- Bar, Ibn Hazm, Ibn Amer and others. The controversy did not stop at the previous two types, but rather moved to a higher and more refined controversy, which is the philosophical one, whose circle expanded after it remained limited and abhorred during the 5 and 6 AH / 11 and 12 AD. The philosophical controversy stirred new issues within the Andalusian arena, including; the issue of: The attempt to reconcile between Sharia and wisdom - philosophy - which was met with a response and rejection of everything that is philosophical in the field of Islamic law, and the most famous participants in this type of debate are Ibn Al- Sayegh (Ibn Bajja) and Ibn Tufail, and the most renowned among them is Ibn Rushd Al hafid.. This controversy ended in intense authorship. The controversy in Andalusia during the aforementioned stage made it possible to raise many intellectual issues between jurisprudence, theological and philosophical matters that affected the authorship movement in Andalusia.
