dc.description	The process of adapting a contractis a mechanism through which the content of the contract isdetermined and its legal frame work is de termined. This processfinds its basis in the issue of dividing contract intonated and unnamed and the resulting possibility of the first beingsubject to legislative eregulation without the other. When the competent person implements this mechanism, he must rely on the sources of legislation in order to attacheach contract to its correct legal framework, as well as the necessity of providing prior legal processes represented in the divisions of contracts, which juristsconsider to be the basic reference for the process of adapting the contract. This process requires the availability of several elements in order for it to be correct sothatitdoes not deviate from the will of individuals. These elements maybe permanent or occasional, in addition to researchinto the structure and composition of the contract, which has an effective role in knowing the applicable law, especially if the contract in dispute iscomplex.	en_US
dc.description.abstract	إن عملية تكييف العقد هي آلية يتم من خلالها تحديد مضمون العقد فتحدد إطاره القانوني وتجد هذه العملية مستقرها في مسألة تقسم العقود إلى مسماة وغير مسماة وما ينتج عنها من قابلية خضوع الأولى لتنظيم تشريعي دون الأخرى. وعندما يفعل صاحب الاختصاص هذه الآلية يجب عليه ان يستند على مصادر التشريع وذلك لإلحاق كل عقد بإطاره القانوني الصحيح وكذا ضرورة توفر عمليات قانونية مسبقة تتمثل في تقسيمات العقود والتي يعتبرها الفقهاء المرجعية الأساسية لعملية تكييف العقد. وتستلزم هذه العملية توفر عدة عناصر لتقوم صحيحة كي لا تحيد عن إرادة الأفراد، وقد تكون هذه العناصر دائمة أم عرضية، بالإضافة إلى البحث في بنيان العقد وتركيبته والذي له دور فعال في معرفة القانون الواجب التطبيق خاصة إذا كان العقد محل النزاع مركبا	en_US
