| Résumé: | لم يعد المشرع الجزائري ينظر للنفايات على أساس أنها مواد يجب التخلص منها ، بل تحولت نظرته اليها باعتبارها مادة أولية ، يمكن اعادة استثمارها و الاستفادة منها ، من خلال إتباع الطرق المستدامة للتسيير من جمع، نقل، فرز، تدوير وتثمين النفايات القابلة للاسترجاع، وكذا تقنية الردم التقني للتخلص النهائي من الجزء غير القابل للاسترجاع منها، الامر الذي الزم المشرع الجزائري بسن اول قانون يتعلق بتسيير النفايات و مراقبتها وازالتها وهوالقانون رقم 01-19 المؤرخ في 21 ديسمبر 2001، كذلك الارتقاء بالترسانة القانونية للتأطير القانوني للنفايات التي انعكست في العديد من النصوص القانونية، كقانون رقم 03-10 المتعلق بحماية البيئة في اطار التنمية المستدامة، والقانون رقم 11-10 المتعلق بالبلدية ،والقانون 12-07 المتعلق بالولاية ، و المرسوم التنفيذي رقم 02-175 المتضمن انشاء وكالة وطنية للنفايات وتنظيمها و عملها ....... الخ، حيث اتجهت الجزائر الى آليات تثمين النفايات وسعيا الى تحقيق التنمية المستدامة بالرغم من النسب المنخفضة للتثمين مقارنة بحجم النفايات المتولدة. |
| Description: | The Algerian legislature no longer views waste as materials to be disposed of, but rather its perspective has shifted to seeing it as a raw material that can be reinvested and utilized. This is achieved by following sustainable methods of waste management, including collection, transportation, sorting, recycling, and valorization of recoverable waste, as well as the use of technical landfilling for the final disposal of non-recoverable waste. This necessitated the Algerian legislature to enact the first law regarding waste management, monitoring, and removal, Law No 01-19 dated December 12, 2001. Additionally, there has been an enhancement of the legal arsenal for the legal framework of waste, reflected in numerous legal texts such as Law No 03-10 concerning environmental protection within the framework of sustainable development, Law No 11-10 concerning municipalities, Law No 12-07 concerning provinces, and Executive Decree No 02-175 establishing a national agency for waste and regulating its work, among others. Algeria has shifted towards waste valorization mechanisms in pursuit of sustainable development, despite the low rates of valorization compared to the volume of generated waste |
