| Abstract: | إن الثورة التي حدثت في مجال المعلوماتية قد أدت إلى إرتكاب سلوكيات غير المشروعة فرضت إضفاء الصفة الجرمية عليها سماها المشرع جرائم تكنولوجيات الإعلام والاتصال، ولضمان فعالية متابعتها، تم إنشاء قطب جزائي متخصص في هذا النوع من الجرائم زوده المشرع بمهمة المتابعة والتققي فيها وكذا الحكم في الجنح المتعلقة بها، وتبدو أهمية الموضوع في إبراز القيمة المضافة التي يحققها وجود هذا القطب الجزائي الوطني المتخصص في مثل هذه الجرائم، حيث وقفنا على مختلف الدوافع التي تستدعي التخصص في متابعة هذه الجرائم وكذا إلى طبيعة الإجراءات المتبعة، لنتوصل إلى نتيجة مفادها أن التقدي لمكافقة هذه الجرائم يبقى مرهونا بفعالية الجهاز القضائي من حيث تخصص القضاة، وكذا بتعاون مختلف الأجهزة الإدارية لاسيما الهيئة المكلفة بالوقاية من هذه الجرائم وكذا تفعيل التعاون القضائي الدولي للكشف عنها. |
| Description: | The revolution that occurred in the field of informatics has led to the commission of illegal behaviors that forced the legislator to give them a criminal character. The legislator called them crimes of information and communication technologies. To ensure the effectiveness of their follow-up, a penal office was created specializing in this type of crime. The legislator provided it with the task of following up and investigating them, as well as adjudicating misdemeanors. related to them, and the importance of the topic appears in highlighting the added value achieved by the presence of this national penal center specializing in such crimes, as we examined the various motives that require specialization in following up on these crimes, as well as the nature of the procedures followed, to reach the conclusion that applying to prosecute these crimes It remains dependent on the effectiveness of the judicial system in terms of the specialization of judges, as well as the cooperation of various administrative bodies, especially the body charged with preventing these crimes, as well as activating international judicial cooperation to detect them. |
