| Résumé: | يعتبر الخطأ الطبي الموجب للمسؤولية الجنائية أهم ركن من أركان المسؤولية الطبية الجنائية و يعرف بأنه خروج الطبيب عن أصول مهنته وعدم بذل العناية اللازمة، فالمسؤولية الجزائية للطبيب تعتبر إقرارا للحماية القانونية التي منحها المشرع للأشخاص من أخطاء الطبيب خلال ممارسة أعماله المهنية ، حيث أن هذه المسؤولية تقوم على ثلاث أركان و يقع عبئ إثباتها على عاتق المضرور(المريض) الذي يواجه صعوبة في إثبات هذه الأركان (الخطأ ، الضرر، علاقة السببية ) المقيمة للمسؤولية الجزائية، فيحتاج إلى خبرة طبية تثبت، كل هذا يعرض الطبيب للمساءلة القانونية و الى العقوبات جزائية. |
| Description: | Medical error that leads to criminal liability is considered the most important pillar of criminal medical responsibility and is defined as the doctors departure from the principles of his profession and failure to exercise the necessary care. The doctors criminal liabilitiy is considered an acknowledgment of the legal protection granted by the legislator to people from the doctors error during the practice of his professional work, as this responsibility it is based on three elements, and the burden of provin git falls on the injured person(the patient), who faces difficulty in proving these elements( error, damage, causal relationship) that establish criminal liability, and so he needs medical expertise to prove the damage that befell the latter. All of this exposes the doctor to legal accountability and criminal penalties |
