| Résumé: | يقتصر موضوع هذه المذكرة حول التعويض عن الخطأ القضائي في القانون الجزائري، حيث يترتب هذا التعويض في حالة ارتكاب القاضي لخطأ شخصي مرتبط بالمهنة، وفي حالة إصدار حكم جنائي صادر بالإدانة كالحكم على شخص ظلما، وفي حالة الحبس المؤقت غير المبرر كالحكم بحبس شخص وهو بريء، كما يجب التعويض عن الأخطاء التي يرتكبها ضباط الشرطة القضائية أثناء أدائهم لعملهم . |
| Description: | The subject of this memorandum is limited to compensation for judicial error in Algerian law, as this compensation arises in the event that the judge commits a personal error related to the profession, in the event of issuing a criminal judgment issuing a conviction, such as sentencing a person unjustly, and in the case of unjustified temporary detention, such as ruling to imprison a person who is innocent. Compensation must also be made for errors committed by judicial police officers while performing their work. |
