| Résumé: | إن النصوص القانونية ذات الطابع الجنائي تلعب دورا مهما في ضمان احترام علاقات العمل، وخصوصا حقوق العمال باعتبارهم أنهم الطرف الضعيف في العقد الذي يجمعهم بصاحب العمل، وذلك في المستويين بداية من المستوى الفردي لعلاقات العمل حيث وفرت هذه النصوص والتي نذكر منها قانون علاقات العمل، حماية جزائية لأهم حقوق العامل من أجر وراحة وصولا حتى لبيئة العمل وحق العامل في الحفاظ على منصب عمله، أما على المستوى الجماعي بدأ المشرع الجزائري بإقراه حق العمال في تسيير شؤون مؤسستهم عن طريق مايعرف بلجنة المشاركة، إضافة إلى الدفاع عن حقوق بشكل جماعي عن طريق الممارسة النقابية والحق في الإضراب. إذن ما يستشف هنا هو أن المشرع الجزائري سعى لتكريس منظومة قانونية تهدف إلى حماية حقوق العامل من أي سلوك يهدف إلى المساس بها. |
| Description: | Legal texts of a criminal nature play an important role in ensuring respect for labor relations, especially the rights of workers as they are the weak party in the contract that brings them together with the employer, at both levels, starting with the individual level of labor relations, where these texts, of which we mention the Labor Relations Law, provide protection. Penal for the most important rights of the worker, from wages and rest to even the work environment and the worker’s right to maintain his job position. As for the collective level, the Algerian legislator began to recognize the right of workers to manage the affairs of their organization through what is known as the Participation Committee, in addition to defending rights collectively through trade union practice. And the right to strike. So what is evident here is that the Algerian legislator sought to establish a legal system aimed at protecting the worker’s rights from any behavior that aims to infringe upon them |
