| dc.description | Unjust enrichment is one of the general sources of obligation that falls under the framework of quasi-contracts. This term refers to a person benefiting from an advantage or money without a legitimate legal basis or acceptable reason, occurring at the expense of another. In this context, the person who has been enriched must compensate the other party for the loss they have incurred due to this enrichment. To bring a legal action on the grounds of unjust enrichment, several conditions must be met: First, there must be an enrichment of the person who is considered the debtor in this case; secondly, this enrichment must have caused a loss to the other person who becomes the creditor by virtue of it; and thirdly, the enrichment must be without a legitimate legal justification. The Algerian legislator has regulated this principle through laws that deal with two specific cases: undue payment and surplus. Although each case has its legal provisions distinct from the general principle of unjust enrichment, the foundation remains the same in that the enrichment has occurred at the expense of someone else's financial estate. | en_US |
