| Résumé: | المحاكمة الإلكتًرونية هي نظام للتقاضي أمام الجهات القضائية عن بعد "دون الحضور الجسدي"، يتم فيها اللجوء إلى الوسائل الإلكتًرونية لتحقيق الحضور الافتراضي، حيث تمكن للشخص المعني سماع ورؤية ما يدور في الجلسة المعروضة على موقع المحكمة المختصة تو على تطبيقها الرسمي التي سجل دعواه الالكترونية فيها او في احدها. |
| Description: | Electronic trial is a system of litigation before the judicial authorities remotely, without physical presence, in which electronic means are used to achieve virtual attendance, where the person concerned can hear and see what is going on in the hearing one the competent court’s website or on its official application in which he or she has registered his or her electronic case. The use of Remote visual conversation technology in some investigative and trial procedures, is one of the most important aspects of modernizing justice, as the adoption of this technology is of great importance in establishing the principle of speed of procedures, and this is through the procedural controls established by the Algerian legislator in the application of this technology. However, it has an impact on the guarantees of a fair trial, especially with regard to the rights of the defense and respect for the principle of primacy between litigants and evaluation of the effectiveness of this system in the face of emergency circumstances that may hinder the normal course of litigation procedures. |
