| dc.description | The amnesty system is one of the most important criminal systems introduced by the legislator to ensure the rights and freedoms of individuals. The highest law in the state, which is the constitution, guarantees this system and it is also enshrined in many laws, including the Penal Code. There are two main types of amnesty: general amnesty and presidential amnesty. The former involves removing criminal status from actions, thus moving them from the realm of criminality to that of legality. As for presidential amnesty, it means that the state relinquishes its right to impose punishment on those who have been charged with a crime. The legislator has established procedures for issuing both types of amnesty, which have numerous criminal effects and extend to civil and disciplinary fields as well | en_US |
| dc.description.abstract | يعد نظام العفو أحد اهم الأنظمة الجزائية التي جاء بها المشرع من اجل ضمان حقوق وحريات الأفراد، إذ نجد أن هذا النظام مكفول بموجب أسمى قانون في الدولة المتمثل في الدستور، كما كرسه أيضا في العديد من القوانين أولها قانون العقوبات. ولهذا النظام نوعين أساسيين متمثلين في العفو الشامل والعفو الرئاسي، إذ يتمثل الأول في نزع صفة التجريم عن الأفعال ليخرج بذلك من دائرة التجريم إلى دائرة الإباحة، اما بالنسبة إلى العفو الرئاسي فمعناه تخلي الدولة عن حقها في تسليط العقاب على من ثبتت التهمة في حقه، وقد نظم المشرع لكل من هذين النوعين إجراءات لإصداره، وينتج عن تطبيقه العديد من الأثار الجزائية، ويتعدى ليشمل المجال المدني والتأديبي أيضا | en_US |
