| dc.description | Through this research, we have tried to study the various basic legal situations that a public employee goes through during his career, where once he joins his position, he has to exercise the tasks assigned to him, and this is called the status of Doing Service, and every situation in which an employee can be present must be accompanied by an administrative decision regulating it, as a public employee while performing his duties is beset by some circumstances through which his administrative sector can change, or he is forced to suspend the employment relationship temporarily, in case of placement or to perform national service, and these cases are by force of law or at the personal request of the employee, Order No 03/06 has established the cases and situations in which The public employee is present in it, and this is within the sixth part of it. These positions aim to reconcile the rules that regulate the proper conduct of administrative interests, and these positions are also considered a way to adapt the needs of both administration and public employee to achieve a balance between professional and personal life. | en_US |
| dc.description.abstract | اننا ومن خلال هذا البحث حاولنا دراسة مختلف الوضعيات القانونية الأساسية التي يمر بها الموظف العمومي خلال مساره المهني، حيث وبمجرد التحاقه بمنصبه فانه يتعين عليه ممارسة المهام الموكلة اليه وهذا ما يسمى بوضعية القيام بالخدمة، وكل وضعية يمكن أن يتواجد فيها الموظف لابد أن تكون مصحوبة بصدور قرار اداري ينظمها، فالموظف العام أثناء تأديته لمهامه تعتريه بعض الظروف التي يمكن من خلالها تغير سلكه الإداري ، أو يضطر الى توقيف لعلاقة العمل مؤقتا ، في حالة الاستيداع أو لتأدية الخدمة الوطنية، وهذه الحالات تكون بقوة القانون بطلب شخصي من قبل الموظف، ولقد حدد الأمر رقم 06/03 الحالات والوضعيات التي يمكن أن يتواجد فيها الموظف العام وذلك ضمن الباب السادس منه. وهدف هذه الوضعيات الى التوفيق بين القواعد التي تنظم السير الحسن للمصالح الإدارية ،كما تعتبر هذه الوضعيات وسيلة لتكييف احتياجات كل من الإدارة والموظف العام لتحقيق التوازن بين الحياة المهنية والحياة الشخصية | en_US |
