| Résumé: | تتناول الدراسة بطلان براءة الاختراع باستكشاف إمكانية إلغاء براءة اختراع معينة وتتضمن المذكرة تعريفا للبراءة والاختراع وتسلط الضوء على أسباب ومبررات بطلان براءة الاختراع مثل عدم الجدية أو وجود تقنية مشابهة وتتناول أيضا الأسس القانونية والإجرائية التي يمكن استخدامها للطعن في صحة البراءة والسعي إلى توفير فهم شامل لعملية بطلان براءة الاختراع وتأثيرها على حماية الملكية الفكرية والابتكار ثم طرق إجراء دعوى البطلان. يشير مصطلح بطلان براءة الاختراع إلى إلغاء أو إثبات عدم صحة براءة اختراع معينة ويعتبر أمرا هاما في حقل الملكية الفكرية فهو طريقة قانونية للتحقق من صحة البراءة ومدى استحقاقها للحصول على الحماية تكمن أهمية بطلان براءة الاختراع في تحقيق عدة أمور فهو يلعب دورا حاسما في ضمان صحة وقوة البراءات وتعزيز الابتكار والنمو الاقتصادي والمنافسة العادلة في سوق الابتكارات والتكنولوجيا. |
