dc.description	This research included the topic of substantive and procedural penal provisions to protect the marital relationship, which occupies great importance due to the great role that the marital bond plays in forming a family. As the concept of substantive rules turns to those rules that regulate criminalization, whether in terms of clarifying the elements of the crime or the reasons attached to it in terms of aggravation or mitigation, highlighting the developments in Order 15-19 of the penal protection of the marital relationship while the penal and procedural protection aims to establish a procedural feature that takes the form of an exception. On the application of all or some of the general procedural rules in special cases in which the realization of the interest necessitates the determination of this feature, either by replacing one procedural rule with another, or by suspending the application of the procedural rule on a restriction or condition	en_US
dc.description.abstract	شمل هذا البحث موضوع الأحكام الجزائية الموضوعية و الإجرائية لحماية العلاقة الزوجية الذي يحتل أهمية كبيرة نظرا لدور العظيم الذي تلعبه الرابطة الزوجية في تكوين أسرة. إذ ينصرف مفهوم القواعد الموضوعية الى تمك القواعد التي تنظم التجريم سواء من حيث بيان أركان الجريمة أو ما يلحقها من أسباب التشديد أو التخفيف مع إبراز ما جاء به الأمر 15-19من مستجدات للحماية الجزائية للعلاقة الزوجية، أما الحماية الجزائية الإجرائية تستهدف تقرير ميزة إجرائية تأخذ شكل استثناء على انطباق كل أو بعض القواعد الّإ جرائية العامة في حالات خاصة يستلزم تحقيق المصلحة فيها تقرير هذه الميزة و ذلك إما باستبدال قاعدة إجرائية بأخرى أو بتعميق انطباق القاعدة الإجرائية على قيد أو شرط	en_US
