dc.description	The death penalty is considered one of the oldest and most severe punishments for the perpetrators, because the place of pain in it is the eradication of the soul of the convict from existence, which made it a matter of disagreement among the jurists who support it as a deterrent punishment, and those who oppose it under the pretext of its incompatibility with modern criminal policy, which aims to integrate and rehabilitate criminals. dc.description.abstract	تعتبر عقوبة الإعدام من أقدم العقوبات وأشدها وطأة على الجناة، لان محل الایلام فیها استئصال روح المحكوم علیه من الوجود، ما جعلها محل خلاف بین الفقهاء من مؤیدین لها كونها عقوبة رادعة، ومعارضین إیاها بحجة عدم تناسبها مع السیاسة الجنائیة الحدیثة التي غایتها الإصلاح والادماج وتأهیل المجرمین والتشریع الجزائري كغیره من التشریعات عرف عقوبة الإعدام ونظمها في قوانینه الداخلیة، فبین إجراءاتها، ووسیلة تنفیذها، وحتى موانعها، مع احاطتها بضمانات جد محكمة قصد الحیطة من الوقوع في الخطأ فیها، غیر انه في الآونة الأخیرة ولمدة عقود من الزمن تخلى عن تنفیذها تحت ضغوطات دولیة تنادي وتندد بضرورة الغاء هذه العقوبة، وحصرها في نطاق ضیق.	en_US
