| Résumé: | تناولنا خلال هذه المذكرة المعنونة ب"شروط تسليم المجرمين في القانون الجزائري" دراسة الشروط الموضوعية لتسليم المجرمين منها مايتعلق بالجريمة المطالبة التسليم من اجلها ، وتاتي هذه الشروط على شكل مبادئ أقرها التعديل الدستوري لسنة 2020 وفصلت فيه الاتفاقيات المتعددة والثنائية المصادق عليها من قبل الجزائر ، كما خصص المشرع الجزائري فصل لشروط تسليم المجرمين تحت باب المعنون "في تسليم المجرمين" من الكتاب السابع في قانون الاجراءات الجزائية . |
| Description: | During this memorandum, we discussed the conditions for extradition in Algerian law. Studying the objective conditions for the extradition of criminals, including those related to the person whose extradition is required, and some related to the crime for which extradition is required. These conditions come in the form of principles approved by the constitutional amendment of 2020 and detailed in the multiple and bilateral agreements ratified by Algeria. Extradition of criminals under the section entitled “On Extradition of Criminals” of Book VII of the Code of Criminal Procedures. Where we tried, through our presentation of the subject of the memorandum, to highlight the categories that are not extradited to the requesting country, as well as the crimes that may not be extradited. The memorandum included the most important procedural conditions for the extradition of criminals, including: the jurisdictional condition, as it is based in addition to the principle of territoriality to the introduction of the principle of personal and concrete, and even global criminal jurisdiction in some crimes , as well as the requirement of sufficient evidence to accept the request for extradition, which is also a prerequisite for the extradition of criminals. In the subject of the memorandum, we also dealt with the problems faced by the terms of extradition of criminals, whether in the absence or availability of the latter, and this prompted us to search for the most important legal loopholes in order for the extradition procedure to be carried out in an acceptable and correct manner |
