In order to accept the request of the owner of the property, the former owner must prove that he has a legal right to use the property and that the violence committed by him is against the law. Evidence, testimony and documents are often presented to prove that there was an attack. If the claim is successful and it is proven that the property is owned, the court can order that the property be returned to the original owner. | dc.description.abstract | دعوى استرداد الحيازة هي دعوى قانونية تتيح للشخص الذي تعرضت حيازته للاعتداء استرداد الحق في الحيازة على العقار أو الحق العيني العقاري الذي فقده تشير هذه الدعوى إلى حالة حيازة يتم نزاع عليها بين الحائز الأصلي الذي فقد الحيازة والشخص الذي اعتدى عليه واستولى على العقار أو الحق العيني . لكي يتم قبول دعوى استرداد الحيازة، يجب على الحائز الأصلي أن يثبت أنه كان يحتل العقار أو الحق العيني بشكل شرعي وأن الاعتداء الذي تعرض له كان غير قانوني. يتم عادة تقديم الأدلة والشهادات والوثائق لتأكيد الحيازة السابقة والاعتداء الحاصل عليه في حال تم قبول الدعوى وثبوت صحة المطالبة بالحيازة، فإن المحكمة يمكنها أن تصدر حكمًا يقضي برد الحيازة إلى الحائز الأصلي. قد يتم أيضًا تعويض الحائز الأصلي عن الخسائر التي لحقت به نتيجة الاعتداء | en_US |
