| dc.description | The right to the urban activity consisting mainly of the construction is considered as one of the phenomena of practicing the right of landed property and other real rights. In the other side, there is what we call “general order”, in the domain of structuring and urbanization which aims to preserve the public health, general order, the security in addition to the city aesthetic aspect. In the other to reconcile the right to the urban activity and the preservation of the general order in the domain of structuring and urbanization, it is necessary to update the whole of texts which belong to the bound of structuring and urbanization and to use their operational side beginning by the administration considering it as a notoriety of administrative control aiming to preserve the general order, arriving to jurisdiction to resolve the conflicts which can result from this domain. | en_US |
| dc.description.abstract | يعتبر الحق في النشاط العمراني، المتمثل أساسا في عملية البناء، من أحد مظاهر ممارسة حق الملكية العقارية والحقوق العينية الأخرى. وفي مقابل هذا الحق، يوجد ما يعرف بالنظام العام في مجال التهيئة والتعمير، الذي يقتضي المحافظة على الصحة العامة والسكينة العامة والأمن العام ، بالإضافة إلى المظهر الجمالي للمدينة. ومن أجل التنسيق بين الحق في النشاط العمراني والمحافظة على النظام العام في مجال تهيئة والتعمير، لا بد من تفعيل جميع النصوص التي تدخل في إطار التهيئة والتعمير وتكريسها من الناحية العلمية، انطلاقا من الإدارة باعتبارها السلطة الضبط الإداري للمحافظة على النظام العام، وصولا إلى الجهات القضائية ،لحل النزاعات التي قد تتطور في هذا المجال باعتباره حامي الحقوق | en_US |
