| Résumé: | يعد التمويل العقاري أداة قانونية ضرورية للحصول على التمويل اللازم لعقار سكني أو ترميمه أو تحسينه. يتضمن هذا العقد التزاما من الممول بتقديم مبلغ نقدي لطالب التمويل, بهدف تمكينه من شراء عقار أو بنائه أو تجديده’ على أن يلتزم الطالب باعادة دفع قيمة مبلغ التمويل في الآجال المتفق عليها. يتم تحديد حجم التمويل الممنوح استنادا الى الضمانات التي يقدمها المستثمر للممول, ويحتفظ الممول بالحرية الكاملة في اختيار نوع الضمان المناسب لحماية حقوقه ومصالحه. واذا قام المستثمر بأفعال تؤدي الى الى تناقص قيمة الضمان الممنوح للممول أو لم يسدد الأموال المستحقة عليه, فللممول الحق في التنفيذ على العقار الضامن اذا لم يقم المستثمر بتقديم ضمانات كافية أخرى للممول, أو لم يسدد أقساط مبلغ التمويل في الوقت المحدد. |
| Description: | Real estate financing is a necessary legal tool to obtain the necessary funding to purchase, renovate or improve a residential property. This contract includes the commitment of the financier to provide a cash amount to the loan applicant, in order to enable them to purchase, build or renovate a property, with the understanding that the borrower will commit to repay the loan amount within the agreed-upon terms. The size of the granted financing is determined based on the guarantees provided by the investor to the financier, and the financier retains full freedom to choose the appropriate guarantee to protect their rights and interests. If the investor takes actions that lead to a decrease in the value of the guarantee provided to the financier or fails to pay the due amounts, the financier has the right to execute the guaranteed property if the investor did not provide sufficient additional guarantees to the financier, or failed to pay installments of the loan amount on time. |
