| Résumé: | الرقابة الإدارية للتهيئة العمرانية تتم عن طريق هيئات ومؤسسات حكومية مختصة في مُّجال التخطيط العمراني والتنمية العمرانية. تقوم هذه الهيئات بضبط السياسات واللوائح والمعاييْر اللازمة للتهيئة العمرانية، وتنظم تنفيذها ومتابعتها. تعمل هذه الهيئات على ضمان الامتثال للمعاييْر البنائية والاستخدامات الأرضية المحددة والحفاظ على جودة المشاريع العمرانية. تشمل الرقابة الإدارية للتهيئة العمرانية عدة نشاطات، مثل: 1 .الموافقة على التصاميم العمرانية والتخطيطات العامة: تقوم الهيئات الإدارية بمراجعة واعتماد التصاميم العمرانية والتخطيطات العامة للمشاريع العمرانية، وذلك للتحقق من توافقها مع اللوائح والمعاييْر المعتمدة والتأكد من تلبية المتطلبات البيئية والاجتماعية والاقتصادية. 2 .منح التراخيص العمرانية: تقوم الهيئات الإدارية بمنح التراخيص العمرانية للمشاريع العمرانية المختلفة، بناءً على الالتزام بالقوانين واللوائح المعمول بها. يتم تقييم المشروع من حيث المتطلبات الهندسية والبيئية والأمنية والصحية وغيْرها. 3 .مراقبة التنفيذ: تقوم الهيئات الإدارية بمتابعة ومراقبة تنفيذ المشاريع العمرانية للتأكد من الامتثال للمعاييْر والمواصفات والجودة المطلوبة. قد تشمل ذلك زيارات الموقع وفحص المواد المستخدمة ومراجعة التقارير الفنية والمالية. أما الرقابة القضائية للتهيئة العمرانية، فتتم عن طريق الهيئات القضائية المختصة. تقوم هذه الهيئات بنظر الدعاوى والنزاعات المتعلقة بالتهيئة العمرانية، سواء كانت مخالفات للقوانين واللوائح أو نزاعات بين الأطراف المعنية. تحكم الهيئات القضائية بناءً على القوانين والأنظمة المعمول بها، وتصدر الأحكام والقرارات الملزمة للأطراف المعنية. |
| Description: | Administrative control of urban planning is carried out through government bodies and institutions specialized in the field of urban planning and urban development. These bodies shall set the policies, regulations and standards necessary for urban planning, and shall regulate their implementation and follow-up. These bodies work to ensure compliance with construction standards, specific land uses and maintain the quality of urban projects. Administrative control of urban planning includes several activities, such as: Approval of Urban Designs and General Planning: Administrative bodies review and approve urban designs and general plans for urban projects, in order to verify their compliance with approved regulations and standards and to ensure that environmental, social and economic requirements are met. 2. Granting Urban Licenses: Administrative bodies grant urban licenses for various urban projects, based on compliance with applicable laws and regulations. The project is evaluated in terms of engineering, environmental, security, health and other requirements. 3. Implementation monitoring: The administrative bodies follow up and monitor the implementation of urban projects to ensure compliance with the required standards, specifications and quality. This may include site visits, inspection of materials used, and review of technical and financial reports. Judicial control of urban planning is carried out through the competent judicial bodies. These bodies hear lawsuits and disputes related to urban planning, whether they are violations of laws and regulations or disputes between the concerned parties. Judicial bodies shall rule based on the laws and regulations in force, and shall issue judgments and decisions binding on the parties concerned. |
