| Résumé: | يعد البيع العقاري من أكثر البيوع أهمية وشيوعا في التعامل، لكونه منصب على العقار وذلك بالنظر للمكانة التي يحتلها هذا الأخير في الإقتصاد الوطني للدول، لذلك إجتهد المشرع الجزائري بس ترسانة من الأسس والأحكام القانونية ورد بعضها في القانون المدني وبعضها في قانون الإجراءات المدنية والإدارية والبعض الأخر في عدة قوانين خاصة، ولعل أهم أحد هذه البيوع هي البيوع القضائية للعقارات، وهذه البيوع ذات طبيعة خاصة لأنها تخص فئة معينة من الأشخاص وهم كل من ناقص الأهلية والمفقود والمفلس والتي يتم بيع عقاراتهم بترخيص من القاضي وهذا بموجب إذن يمنحه القاضي لنائب الشرعي ببيع عقاراتهم، والعقارات التي تكون مملوكة على الشيوع وذلك في حالة إستحالة القسمة العينية بناء على خبرة القضائية وبهذه تأمر المحكمة ببيع العقار المشاع عن طريق إجراءات البيع بالمزاد العلني وتوزيع حصيلة البيع بالمزاد على أطراف البيع، وهذه الإجراءات تبدأ بمرحلة تحضير العقار للبيع ابتداء من إعداد قائمة شروط البيع وإيداعها بأمانة ضبط المحكمة والإنذار بالاطلاع عليها، ثم الفصل في جميع الإعتراضات الى غاية المرحلة الثانية وهي إجراءات البيع التي تبدأ من تحديد جلسة ومكان البيع وإجراءات الإعلان وإجراءات سير الجلسة والعوارض التي قد تحدث لها، ثم تنتهي هذه الإجراءت بصدور حكم رسو المزاد وما تترتب عليه من آثار قانونية، وتوزيع حصيلة البيع على أطراف البيع حسب حالة، والشيء الملاحظ هنا أن المشرع لم يفصل في إجراءات البيع بالمزاد العلني للبيع القضائي للعقار، وإنما أحال بموجب نصوص مواد قانون الإجراءات المدنية والإدارية المعدل والمتمم على الأحكام المتعلقة بإجراءات بيع العقارات المحجوزة، وهذا ما أكدته المادة 789 منه. |
| Description: | The real estate sale is considered one of the most important and common sales in dealing, because it is focused on the real estate, given the position that the latter occupies in the national economy of the countries, so the Algerian legislator has worked hard, but an arsenal of legal foundations and provisions, some of which are mentioned in the civil law and some in the law of civil and administrative procedures and some others In several special laws, and perhaps the most important one of these sales is the judicial sales of real estate, and these sales are of a special nature because they belong to a certain category of people, and they are all those who are incapacitated, missing, and bankrupt, and whose real estate is sold with a license from the judge, and this is according to the permission that the judge gives to the Sharia representative to sell their real estate. And real estate that is owned in common, in the event that it is impossible to divide in kind based on judicial experience. Thus, the court orders the sale of the common property through auction sales procedures and the distribution of the sale proceeds by auction to the parties to the sale, and these procedures begin with the stage of preparing the property for sale starting from preparing a list of sale conditions and Depositing it in the court's control trust and warning to see it, then deciding on all objections until the second stage, which is the sale procedures that take place Beginning with determining the session and place of the sale, the announcement procedures, the procedures for conducting the session, and the incidents that may occur to it, then these procedures end with the issuance of the award of the auction and its legal effects, and the distribution of the proceeds of the sale to the parties of the sale according to the case, and the thing that is noted here is that the legislator It did not decide on the procedures for selling by public auction for the judicial sale of real estate, but rather referred it according to the provisions of the articles of the Civil and Administrative Procedures Law to the provisions related to the procedures for selling seized real estate, and this is confirmed by Article 789 thereof. |
