dc.description	The public funds is one of the most important means by which the public administration seeks to achieve its economic and social objectives and thus achieve integrated national development, in addition to the protection afforded to it by civil law and special laws such as the prohibition of its disposal, assignment, appropriation or seizure. It was necessary to establish a dissuasive criminal protection that criminalizes all kinds of offenses, especially after the spread of the phenomenon of administrative corruption of all kinds in recent times, so this research paper aims to study the most important widespread crime committed by the public official, which is the Diversion of public funds in the public sector The legislator has issued a regulation under the amended and supplemented Law No 01/06 on the law relating to the prevention and fight against corruption.	en_US
dc.description.abstract	يعد المال العام من أهم الوسائل التي تسعى الإدارة العامة من خلاله تحقيق أهدفها الاقتصادية والاجتماعية وبالتالي تحقيق تنمية وطنية شاملة، فبالإضافة الى الحماية الممنوحة له ضمن القانون المدني والقوانين الخاصة المنظمة له على أنه لا يجوز التصرف فيه أو حجزه أو اكتسابه، كان ولا بد من وضع حماية جزائية ردعية تجرم كل أنواع المساس به خاصة بعد انتشار ظاهرة الفساد الإداري بكل أنواعها في الآونة الأخيرة، لذلك تهدف هذه الورقة البحثية إلى دراسة أهم جريمة منتشرة ومرتكبة من قبل الموظف العمومي، وهي اختلاس الأموال العمومية في القطاع العام التي خصص لها المشرع تنظيم ضمن قانون 06/01 المعدل والمتمم المتعلق بقانون الوقاية من الفساد ومكافحته .	en_US
