dc.description	Mediation is considered one of the amicable methods for settling commercial and investment disputes, in light of the current global trend that seeks to abandon traditional litigation systems to alternative amicable dispute settlement systems. Through this research; we review the concept of mediation, the nature of the agreement and its forms, and the disputes that are not accepted for settlement, as well as those disputes that accept settlement through mediation. This in addition to studying the effects of the mediation agreement in terms of the obligation and rights of the parties to the commercial and investment dispute resulting from the mediation agreement.	en_US
dc.description.abstract	تعتبر الوساطة أحد الوسائل الودية لفض المنازعات التجارية ومنازعات الاستثمار، في ظل الاتجاه العالمي الحالي الذي يسعى للعزوف عن نظم التقاضي التقليدية إلى نظم ودية بديلة لتسوية المنازعات؛ ومن خلال هذا البحث نستعرض مفهوم الوساطة وماهية الاتفاق الخاص بها وصوره والمنازعات التي لا تقبل التسوية بها، وكذا تلك المنازعات التي تقبل التسوية بالوساطة؛ هذا إلى جانب دراسة آثار اتفاق الوساطة من حيث التزامات وحقوق أطراف المنازعة التجارية والاستثمارية الناتجة عن اتفاق الوساطة	en_US
