dc.description	This stat’s interference in the field of contracts appears by controlling the nature of the contract by granting independent administrative authorities powers to decide whether or not to grant licences to anyone who requests this capacity in order to begin concluding contracts with others, economic and its efforts to foster contractual relations and achieve the general interest of member of society. To devote this intervention in the economic field, the legislator enacted special laws to restrict freedom of contract and direct the contract and make it a protective means for the weak contracting party with the aim of serving the public interest of both parties, for this reason, the contractual relationship was set with peremptory rules and established severe penalties for its breach.	en_US
dc.description.abstract	يظهر تدخل الدولة في مجال العقود من خلال ضبط صفة التعاقد بإعطاء السلطات الإدارية المستقلة صلاحيات تقرير منح الرخص من عدمه لكل من يطلب هذه الصفة كي يباشر إبرام العقود مع الغير، ولها حق توقيع جزاءات إدارية على إخلال طالب الرخصة، وهذا يدل على حرصها على تنظيم السوق الاقتصادية وما تبذله من مجهود لرعاية العلاقات التعاقدية وتحقيق المصلحة العامة لأفراد المجتمع. لتكريس هذا التدخل في المجال الإقتصادي، قام المشرع بسن قوانين خاصة لتقيد حرية التعاقد وتوجيه العقد وجعله وسيلة حمائية للمتعاقد الضعيف والهدف منها خدمة المصلحة العامة للطرفين، لهذا ضبط العلاقة التعاقدية بقواعد آمرة وقرر عقوبات صارمة للإخلال بها.	en_US
