| Résumé: | يكتب الملخص في حدود 100 كلمة (بخط Arabic Typesetting ، مقاس 16). تعتبر الخطبة خطوة أولى لبداية إبرام عقد الزواج، فهي لا تتمتع بأي قوة إلزامية بالنسبة للطرفين معا، لذلك يجوز لكل طرف العدول عن الخطبة. إلا أنّ هذا العدول قد يترتب عنه ضررا ماديا أو معنويا، وقد أجاز قانون الأسرة في المادة 05 منه للطرف المتضرر أن يطالب بالتعويض عن الضرر المادي والمعنوي، وأكثر من ذلك يمكن له أن يطالب باسترداد الهدايا بل وحتى الصداق في حالة ما إذا تم دفعه خاصة وأن المشرع لم يتكلم عن مصير هذا الأخير في حالة العدول عن الخطبة. لذلك نوصي المشرع بضرورة تنظيم مسألة الخطبة بمواد أكثر تكون واضحة ومفصلة؛ حتى يسهل معرفة أحكام تلك المسائل وتوحيد العمل القضائي. |
| Description: | The engagement is a first step towards the beginning of the marriage contract, as it does not have any mandatory force for both parties, so each party may refrain from the engagement. However, such a reversal may result in material or moral damage, and the Family Code in article 05 of it has authorized the injured party to claim compensation for material and moral damages, and more than that it can claim the return of gifts and even friendship in the event of payment, especially since the legislator has not spoken of the fate of the latter in the event of a renuncence of the sermon. We therefore recommend to the legislator that the issue of engagement should be regulated with more clear and detailed materials, so that the provisions of those matters can be easily known and judicial work consolidated. |
