| dc.description.abstract | يكتسي موضوع بطلان الإجراء الجزائي أهمية بالغة باعتباره جزاء إجرائيا يلحق كل إجراء تم بالمخالفة لنموذجه المرسوم قانونا، وذلك لارتباطه بحماية حقوق الدفاع، وقد أخذ قانون الإجراءات الجزائية الجزائري بمذهبي البطلان القانوني والبطلان الجوهري، بحيث نص على ضرورة مراعاة بعض الإجراءات تحت طائلة البطلان، في حين ترك حالات البطلان الأخرى للقضاء يتولى تقريرها والحكم بها ،ويترتب عن ذلك أن البطلان لا يؤثر على الإجراءات السابقة وإنما على الإجراء المعيب نفسه أو الإجراءات اللاحقة له مع إمكانية تحوله إلى إجراء صحيح متى توافرت شروطه القانونية. | en_US |
