| Résumé: | يعتبر مبدأ التقاضي على درجتين ضمانة أساسية لتحقيق العدالة الجزائية، دفعت بالمشرع إلى إقراره في المادة الجنائية بعدما كان يقتصر على أحكام الجنح والمخالفات، وقد ترتب على ذلك استحداث محكمة جنايات استئنافية بوصفها درجة تقاضي ثانية، غير أن وجود هذه المحكمة في نفس جهة تقاضي محكمة الجنايات الابتدائية وبنفس تشكيلتها ماعدا تغير صفة الرئيس من رتبة مستشار إلى رتبة رئيس غرفة، وأيضا الأثر الناقل لحكم الجنايات المستأنف، ترتب عنه إخلالا بمقتضيات مبدأ التقاضي على درجتين مما يحول دون تحقيق الأهداف المرجوة منه. |
| Description: | The double-hearing principle of litigation is considered as a basic guarantee to achieve the Criminal Justice which led the Algerian legislator to acknowledge it in the criminal cases after having been limited to delicts provisions and offences, this had resulted the creation of the Criminal Appeals Court as a second level of litigation. However, there is a violation of terms of the double-hearing principle of litigation which prevents from achieving the desired objectives because of the existence of this Criminal Appeals Court in the same jurisdiction and the same form as the Criminal Lower Court except the change of quality of the president from a consultant to a president of chamber, in addition to the substantiating effect of the appellate criminal judgement. |
