dc.description	The recent development has created equipment with a significant financial value that is difficult to pay for immediately, which necessitated the adoption of the idea of credit as a guarantee for the risks of non-payment. In order to collect the value of the debt, a set of procedures are adopted to reach the stage of selling by public auction the mortgaged equipment for the interest of the bank, which is faced with problems resulting from the legal texts regulating them and the lawsuits filed with the purpose of obstruction, in addition to preventing the completion of the sale process and the transfer of ownership, which calls for the necessity of Organizing the procedural aspect of how to sell in a simplified and accurate manner that enables the bank to obtain its dues while saving effort, time and costs.	en_US
dc.description.abstract	إن التطور الحديث قد أوجد عتادا بقيمة مالية معتبرة يصعب دفع ثمنها على الفور ، الأمر الذي استدعى تبني فكرة الإئتمان ضمانا لمخاطر عدم الوفاء. و لتحصيل قيمة الدين فإنه يتم اعتماد مجموعة من الإجراءات وصولا لمرحلة البيع بالمزاد العلني للعتاد المرهون رهنا حيازيا لمصلحة البنك ، و التي تعترضها إشكالات ناتجة عن النصوص القانونية المنظمة لها و الدعاوى المرفوعة بغرض العرقلة إضافة إلى منع استكمال عملية البيع و نقل الملكية ، مما يستدعي ضرورة تنظيم الجانب الإجرائي المحدد لكيفية البيع بشكل مبسط و دقيق يمكن البنك من الحصول على مستحقاته مع توفير الجهد و الوقت و التكاليف.	en_US
