dc.description	In the light of the Algerian constitutional amendment 2020, this article come to study the submission of ordinances of the President in urgent matters in the absence of Parliament, as well as the decisions of the event of state of emergency, to the control of the Constitutional Court, because these mechanisms escape control in the constitution of 1996, with its various amendments, until 2016, given the issue has not been resolved clearly. This has led us to a study of the provisions governing this jurisdiction, and we have found an ambiguity, which makes interpretation difficult, which requires more clarification in order to qualify the Constitutional Court to play a central role to regulate the functioning of constitutional institutions.	en_US
dc.description.abstract	على ضوء التعديل الدستوري الجزائري لسنة 2020، جاء هذا المقال لدراسة مسألة اخضاع الأوامر التي يتخذها رئيس الجمهورية في مسائل عاجلة في حالة غياب البرلمان، إضافة إلى تلك التي يتخذها أثناء الحالة الاستثنائية، لرقابة المحكمة الدستورية، على اعتبار أن تلك الأليات القانونية كانت في منأى عن تلك الرقابة في دستور سنة 1996 بتعديلاته المختلفة لغاية سنة 2016، لعدم حسم المسألة بطريقة واضحة. الأمر الذي قادنا إلى دراسة تحليلية لتلك الأحكام المنظمة لذلك الاختصاص، فوجدنا أن عدم وضوح الصياغة لتلك الأحكام يجعل التأويل وفق عدة احتمالات، مما يستوجب مزيد من التوضيح لتأهيل المحكمة الدستورية للعب دور محوري لضبط عمل المؤسسات الدستورية.	en_US
