dc.description.abstract	من المسلمات أنّ للطبّ أهمية كبيرة في المحافظة على النّفس البشرية التي تعتبر أحد المصالح الخمسة التي حمتها مختلف التشريعات ومنها التشريع الجزائري، غير أن تدخّل الطبيب في الممارسة الطبّية يحتم المساس بجسم المريض، الأمر الذي يتطلّب وضع ضوابط يجب أن يتقيّد بها العمل الطبّي حتى لا يخرج عن هدفه المتمثل في المحافظة على الحياة وصيانة الجسم البشري. إنّ مبدأ حرمة جسم الانسان يقتضي حظر المساس به، إلاّ أن ضرورة العلاج تبرّر ما هو محظورا بمعنى أنّ مبدأ حرمة جسم الإنسان ليس بالمبدأ المطلق، وإنّما يحتمل الاستثناء في حدود ما يسمح به القانون	en_US
