dc.description	Most criminal laws have ensured the establishment of a special sanctions system to deal with crimes of corruption in public procurement. public procurement in accordance with the contemporary economic, political and social conditions of each country. There are laws which are distinguished by special laws for acts of corruption comprising texts dedicated to public procurement crimes as well as the sanctions reserved for them. Undoubtedly, the penal sanction in the public markets applies only to the person who committed through his behavior the bases of the crime. This person who commits the criminal act is extracted from the text which criminalizes and punishes him at the same time	en_US
dc.description.abstract	حرصت معظم التّشريعات الجنائية على تقرير نظام عقابي خاص لمواجهة جرائم الفساد في الصفقات العمومية ، وفقا للظروف الاقتصادية و السياسية و الاجتماعية المعاصرة لها في كل دولة ، و هناك من التّشريعات ما أفرد تشريعا خاصا بالفساد تضمّن النص على جرائم الصفقات العمومية و العقوبات المقرّرة لها. و مما لا شك فيه أنّ العقوبة الجزائية في الصفقات العمومية لا تطبق إلاّ على شخص حقّق بسلوكه كل أركان الجريمة ، هذا الشخص الذي يقوم بالفعل المجرّم نستخرجه من نص التّجريم و العقاب نفسه	en_US
