dc.description	The essence of punishment is pain, an element that for years has been the main driver of punitive policy, and there is no way to fight crime except by retaliating against criminals and abusing them. Although the punishment of a person by depriving him of freedom is a repressive means that will deter him and stop his injuries in the future. However, the practical reality revealed in numbers the failure of the negative penalties of freedom to reduce the size and type of the criminal phenomenon, which prompted penal scholars to seek new reactions to punitive treatment, embodied in the punishment of work for public benefit, which this research aims to introduce and address the conditions and procedures of its application as a code reflecting the development of punitive policy in Algeria and its impact on modern trends in criminal policy, mainly the movement of social defense.	en_US
dc.description.abstract	يتمثل جوهر العقوبة في الإيلام هذا العنصر الذي ظل لسنوات المحرك الأساسي للسياسة العقابية فلا سبيل لمكافحة الجريمة إلا بالإنتقام من المجرمين و التنكيل بهم . و بالرغم من أن عقاب الشخص بحرمانه من الحرية يعتبر وسيلة قمعية من شأنها ردعه و كف أذاه في المستقبل . إلا أن الواقع العملي كشف و بالأرقام فشل العقوبات السالبة للحرية في التقليل من حجم و نوع الظاهرة الإجرامية ، الأمر الذي دفع علماء العقاب إلى البحث عن ردود فعل جديدة للمعاملة العقابية، تجسدت في عقوبة العمل للنفع العام التي يهدف هذا البحث إلى التعريف بها و التطرق لشروط و إجراءات تطبيقها كنمودج يعكس مدى تطور السياسة العقابية في الجزائر و تأثرها بالاتجاهات الحديثة للسياسة الجنائية و على رأسها حركة الدفاع الاجتماعي .	en_US
