dc.description	The Algerian project has adopted a strict legal system regarding bankruptcy and affirmed that the trader cannot be declared bankrupt unless a judgment is issued by the competent court ordering his bankruptcy that includes all the data that leave no doubt about the bankrupt person. The legislator did not stop when enacting a law that would regulate the whole issue, but went far when the judge singled out the month of bankruptcy with special attention, so he organized all the judgments and data related to it, especially with the seriousness of the effects arising from the judgment that declares bankruptcy. Thus, after ascertaining the state of cessation of payment and the debtor’s inability to pay his debts in full, the judgment declaring bankruptcy is issued. Whoever is concerned must contest this decision through opposition or appeal without this having the effect of stopping the judgment.	en_US
dc.description.abstract	لقد تبني المشروع الجزائري نظام قانوني صارم بشأن الإفلاس وأكد على أنه لا يمكن القول بإفلاس التاجر إلا إذا صدر حكم عن المحكمة المختصة يقضي بإفلاسه يتضمن جميع البيانات التي لا تترك شكا بشأن شخص المفلس . وهكذا بعد التأكد من حالة التوقف عن الدفع وعدم تمكن المدين من أداء ديونه كاملة يصدر الحكم القاضي بشهر الإفلاس ,يبقي على كل من يهمه الأمر أن يخاصم هذا القرار عن طريق المعارضة أو الاستئناف دون أن يكون لذلك أثر موقف للحكم	en_US
