dc.description	The penal provision consists of a preamble, a reason and an integral part. These parts are a sum of one complementing each other. However, it is true that the elements of penal rule constitute a single logic that can not be divided. The correlation is particularly strong between the two reasons and the relationship between them. The parameters and extent of the relationship, the degree of influence of the causes in the operative, and the extent to which the reasons are influenced by the characteristic characteristics of the operative, particularly in nature and in terms of authenticity	en_US
dc.description.abstract	يتألف الحكم الجزائي من ديباجة وأسباب ومنطوق، وهذه الأجزاء تكون مجموعا واحدا يكمل بعضه بعضا، فيصح مع ذلك القول بأن عناصر الحكم الجزائي تشكل لحمة منطقية واحدة لا تقبل التجزئة، ويشتد الارتباط سيما بين عنصري الأسباب والمنطوق لما بينهما من علاقة، لذلك سعت هذه الدراسة إلى وضع معالم للحدود بين عنصر الأسباب وعنصر المنطوق وكشف العلاقة التي تربط بينهما، وحدود تلك العلاقة ومداها، ودرجة تأثير الأسباب في المنطوق، ومدى تأثر الأسباب بالخصائص التي يتميز بها المنطوق سيما من حيث الطبيعة ومن حيث الحجية.	en_US
