| Résumé: | استقر الفقه القانوني على أن القاعدة الأساسية في تطبيق القانون هو الأخذ بمبدأ عدم رجعية القوانين، أي القانون الذي يصدر جديدا تسري أحكامه من اللحظة التي يصدر فيها إلى المستقبل فلا يكون له أثر عل الماضي، بمعنى أن تخضع له التصرفات التي تنشأ في ظله ،أما التصرفات التي تنشأ قبله فلا أثر له عليها،وبهذا المفهوم يكون لكل قاعدة نطاقها الزمني ،لا يجب أن تتعداه و هذا من متطلبات فكرة الأمن القانوني .ولكن الأمور ليست دائما بهذه الكيفية فقد ينعطف القانون الجديد بأثره على الماضي ليس أمرا مسموح به فحسب و إنما أمر مرغوب فيه ،و على هذا الأساس يرد استثناء على مبدأ عدم رجعية القوانين مما يجعل فكرة الأمن القانوني تهتز إذا لم تراع ضوابط هذه الرجعية . من خلال هذه الورقة البحثية أردنا تسليط الضوء على تحقيق فكرة الأمن القانوني بإعمال مبدأ عدم رجعية القوانين و الاستثناءات الواردة عليه |
| Description: | The jurisprudence has established that the basic rule in the application of the law is the introduction of the principle of non-retroactivity of laws, that is, the law that issues a new law from the moment it is issued to the future has no effect on the past, that is to be subject to the behaviors that arise under it, Which is created before it, has no effect on it. In this sense, each rule has its own temporal scope, which must not be exceeded. This is one of the requirements of the idea of legal security. But this is not always how the new law turns its impact on the past. It is on this basis that there is an exception to the principle The blood of reactionary laws making the idea of legal security vibrating if the controls did not observe this reaction. Through this paper we wanted to highlight the realization of the concept of legal security by implementing the principle of non-retroactivity of laws and exceptions thereto. |
