| Résumé: | إن المتتبع للعلاقات الدولية، وبشكل أدق، العدالة الجنائية الدولية، يمكن أن يستنتج وبوضوح، أن الانتهاكات الخطيرة التي تحصل في العديد من دول العالم، على غرار ما حدث ويحدث في العراق وفلسطين وسوريا و ليبيا واليمن وغيرهم، كانت نتيجة ثقة مرتكبيها من إفلاتهم من العقاب، نظرا لعجز المحكمة عن التصدي للانتهاكات والجرائم الدولية التي تستهدف قواعد القانون الدولي الإنساني خاصة أثناء النزاعات المسلحة، الدولية منها والداخلية، مما جعل هذه الهيئة محل انتقاد من طرف فقهاء ورجال القانون الدولي، خاصة نظامها الأساسي الذي انطوى على الكثير من الثغرات القانونية والقيود التي تحول دون قيام هذه الهيئة بالمهام المرجوة منها |
| Description: | Anyone who has followed international relations, and more precisely, the international criminal justice, it can be concluded and clearly, that the serious violations that occur in many countries of the world, along the lines of what has happened and is happening in Iraq, Palestine, Syria, Libya, Yemen, and others, were the result of the perpetrators the confidence of impunity, due to the inability of the court to address the violations and international crimes against the rules of international humanitarian law, especially during armed conflicts, international and internal, making this body has been criticized by scholars and men of international law, especially its statute, which involved a lot of legal gaps and constraints without this body do the desired tasks. |
