dc.description.abstract	تتمتع الإدارة في مجال حماية البيئة بسلطات وامتيازات قانونية هامة، أبرزها آليات الضبط الإداري البيئي، التي تلعب دور فعالا، في تقويم سلوك الأفراد وتقييد جزء من حرياتهم، وفق ما تقتضيه ضرورات التنمية وحماية مكونات البيئة و مختلف عناصرها، وعلى ذلك تثور مسؤوليتها عن الأضرار البيئية الحاصلة . حيث تهدف هذه الدراسة إلى البحث في الأساس القانوني لمسؤولية الإدارة عن مختلف الأضرار اللاحقة بالبيئة ، باعتبار أن الإدارة العامة مكلفة بالحفاظ عليها وضمان توازن عناصرها، و من ثم فإن مسؤوليتها الإدارية تقوم عند حدوث أي تقصير أو إخلال أو تباطؤ في أداء الواجبات البيئية المفروضة عليها ، فهي ملزمة بتحمل المسؤولية إزاء أي فعل ملوث للبيئة سواء أكان صادرا عن خطئها المرفقي أم عن موظفيها ، أم عن نشاط الهيئات التي تشرف عليها وتوجهها في هذا المجال .كما تقوم مسؤوليتها أيضا على أساس المخاطر	en_US
dc.description.sponsorship	The administration in the field of environmental protection enjoys important legal powers, most notably the mechanisms of environmental administrative control, which play an effective role in evaluating and restricting the behavior of individuals, according to the necessities of development and protection of the components of the environment, and accordingly its responsibility arises for the environmental damages. Where this study aims to research the legal basis for the administration’s responsibility for environmental damage, given that the public administration is charged with preserving it, and therefore its administrative responsibility is established when any breach of the environmental duties imposed on it occurs, it is obliged to take responsibility for any act polluting the environment Whether issued by her service fault or on the basis of risks.	en_US
