| dc.description.abstract | يهدف البحث إلى التطرق لمدى انعكاس استثنائية القواعد القانونية البيئية على مدى مرونة النص البيئي والنظر في درجة تلك الإستثنائية مقارنة بمرونة النصوص القانونية الأخرى كما يهدف للنظر في الملابسات الشكلية والموضوعية للنص البيئي والتي تمدد أو تقلص تلك المرونة في سبيل توفير أكبر حيز يستوعب المستجدات البيئية الراهنة . وقد خلصنا من خلال البحث لكون مرونة النص القانوني البيئي تتأرجح بين المفهوم الفلسفي و الشكلية والموضوعي ، كما أنها تتأثر بالأبعاد السياسية والإقتصادية والإجتماعية وحتى الفنية ، وذلك لكون النص البيئي استثنائيا من حيث خصائصه ، وما يزيد من خصوصية تلك القواعد هي معالجتها لمسائل فنية أكثر منها قانونية كما أنها تتعلق بالضرر البيئي هذا الأخير الذي يعد استثنائيا من حيث الخصائص لا سيما خاصيتي الانتشارية والتراخي | en_US |

We concluded through the research that the flexibility of the environmental legal text fluctuates between the philosophical, formal and objective concepts, as it is affected by the political, economic, social and even technical dimensions , This is because the environmental text is exceptional in terms of its characteristics, and what increases the specificity of these rules is its treatment of technical issues rather than legal ones, as it relates to the latter’s environmental damage, which is exceptional in terms of characteristics, especially proliferation and laxity. | en_US |
